Welcome to delacours.com (the “Website”), the official online store of De la Cours.

GENERAL TERMS AND CONDITIONS OF SALE
1. Acceptance of the General Terms and Conditions of Sale and Conclusion of the Contract
Please read these Website Terms and Conditions of Sale (“Terms of Sale”) carefully before ordering any products through our website (“Products”). Together with our Privacy Policy and our Terms and Conditions of Use, these Terms of Sale govern the contractual relationship regarding this website and the purchase of Products made through it. If you have any questions regarding these Terms of Sale, please contact us at info@delacours.com.
To accept these Terms of Sale, please select the “I Accept” checkbox in the Order Confirmation section before submitting an order (“Order”). If you do not accept these Terms of Sale, you will not be able to place Orders through the De la Cours website.
These Terms of Sale do not affect the rights granted under mandatory applicable laws, including Legislative Decree no. 206/2006 (“Consumer Code”) and Legislative Decree no. 70/2003 (“E-Commerce Code”).
2. Purchase Procedure and Ownership of Products
The products offered for sale are exclusively those available on delacours.com at the time the Order is submitted, as described in the relevant product information sheets.
Please note that images accompanying product descriptions are for illustrative purposes only and may not perfectly represent the product’s actual characteristics, such as color and size differences, also depending on the browser and monitor used to access the Site.
Without prejudice to the above, if the products received do not correspond to those ordered, if the delivery is incomplete, or if damage occurred during transport, users are invited to contact customer support immediately by email at info@delacours.com.
To place an Order, the Customer must complete the appropriate form available on the Site in full and submit it after carefully reviewing these Terms and the characteristics of the product(s) they intend to purchase. The Customer may also request the issuance of a tax invoice pursuant to Article 22 of Presidential Decree no. 633/1972.
Receipt of the Order is confirmed by De la Cours via email sent to the email address provided by the Customer. This confirmation message will summarize the purchase conditions and the information entered in the Order, allowing the Customer to verify the details and promptly communicate any corrections.
Ownership of the products and the related risk transfer from De la Cours to the Customer upon issuance of the fiscal document.
3. Delivery Terms
All orders whose payment is completed by 2:00 PM on a business day are shipped within the following 2–5 business days (excluding Saturdays, Sundays, and public holidays).
Shipping times for Calabria, Basilicata, Sicily, Sardinia, smaller islands, or remote areas are approximately 5–8 business days. Actual delivery dates may vary depending on the destination.
Shipping is not available for addresses located in the Tremiti Islands or other remote areas.
During the Christmas holiday period (December 15th to January 8th) and during the two central weeks of August, order processing times may experience slight delays.
4. Purchases Through a Personal Account or as a Guest
To place an order on De la Cours, users may create a personal account (username and password). Users are responsible for maintaining the confidentiality of their password and restricting access to their account and password, and they accept responsibility for all activities and purchases made through their account.
Alternatively, users may place orders as “guests” without creating or accessing an account.
5. Placing an Order
To purchase products on De la Cours, users must:
- accept these Terms of Sale and acknowledge the Privacy Policy;
- provide their name, address, phone number, email address, payment details, and other required information;
- provide a valid delivery address (De la Cours does not deliver to PO boxes or automated parcel lockers. Orders are shipped by courier and therefore require the signature of a physical person upon delivery);
- when paying by debit/credit card, be the holder or authorized user of a valid debit/credit card; and
- when paying via PayPal, be the holder of a valid PayPal account.
Users may place an order by proceeding to checkout after clicking the “ADD TO CART” button. By doing so, the user acknowledges that their order constitutes an offer to purchase the selected product(s) under these Terms of Sale.
Each product order is considered a separate purchase. All orders are subject to acceptance by De la Cours, which reserves the right to reject any order without explanation, including, but not limited to, suspected fraudulent orders. Users will be notified if De la Cours decides not to accept the order within 1–2 business days.
Prices are regularly verified; however, if De la Cours identifies price changes or errors, users will be contacted to confirm whether they wish to proceed with the purchase at the correct price. Even in the event of confirmation by the user, De la Cours shall not be obligated to deliver the Product until the second Order Confirmation email has been sent.
If the user notices an error in the Order, they are requested to immediately contact De la Cours via email at info@delacours.com.
Before confirming the Order(s), users will have the opportunity to review their Order(s), read and accept these Terms of Sale, verify the total price and product details, and correct any input errors.
6. Order Processing and Contract Formation
Once the Order(s) have been completed following the instructions available on the Site, De la Cours will send an email confirming receipt of the Order(s) and indicating the details of the ordered Product(s) (“Order Receipt Confirmation Email”).
This email does not constitute acceptance of the Order(s); it merely confirms that De la Cours has received the Order(s).
The contract between the user and De la Cours will only be concluded once De la Cours sends the user an email confirming that the Product(s) have been shipped (“Shipping Confirmation Email”).
7. Prices, Taxes, Shipping, and Handling Costs
The price charged for a Product will be the price indicated on the relevant product information page at the time the Order is placed and will also be displayed on the order confirmation page and in the Order Receipt Confirmation Email.
Product prices include VAT or other applicable taxes but exclude shipping and handling costs.
Shipping and handling costs, together with applicable VAT or taxes, will be shown separately on a summary screen before finalizing the Order and in the Order Receipt Confirmation Email. Shipping and handling costs are determined based on the destination and delivery method selected during checkout.
8. Prices and Payment Methods
The following payment methods are accepted:
PayPal
Customers may use the PayPal payment system according to PayPal’s applicable terms and conditions.
Credit Card
For purchases made by credit card, transactions may be processed through the secure Stripe server. At no point during the payment process will De la Cours have access to the Customer’s credit card information, which is transmitted via secure encrypted connection directly to the banking institution handling the transaction.
No De la Cours computer archive will store such data and therefore De la Cours cannot be held responsible for any fraudulent or improper use of credit cards by third parties during payment.
Transaction security, as well as website browsing, is guaranteed through SSL encryption systems and secure certified connections.
9. Product Availability
If a product is no longer available, users will technically be prevented from placing the Order.
Additionally, in rare and unforeseeable cases, a product listed as available may become unavailable after the Order has been placed. In such cases, the contract between the user and De la Cours will not be concluded and the user will be informed accordingly. The unavailable product will not be included in the Shipping Confirmation Email.
If payment has already been made prior to confirmation of the product’s unavailability (for example through PayPal), De la Cours will refund the amounts paid as soon as possible.
10. Right of Withdrawal
The consumer has the right to withdraw from the purchase contract for any reason, without providing explanations and without penalty, within the terms and according to the procedures described below.
To exercise the right of withdrawal, the customer must send a request to info@delacours.com or contact us via WhatsApp within 14 working days from receipt of the products.
Once the withdrawal request has been received, De la Cours will promptly communicate the return instructions and assign a unique return authorization code. The customer will receive an authorization email containing the documentation required to proceed with the shipment.
The return request may only be submitted by the original order holder and must be shipped from the same address used for the original delivery.
The purchased product must be returned intact, unused, unwashed, and otherwise unaltered, complete with all its parts, including its warranty, and in its original packaging (including original wrapping and boxes).
To reduce the risk of damage to the original packaging, it is recommended to place it inside a second box and attach the shipping label provided by De La Cours. Labels or adhesive tape should never be applied directly to the original packaging.
Return shipping costs depend on the reason for the return (standard fee: €8.00).
- Return shipping costs within Italy, inside and outside the European Union, are covered by De La Cours ONLY in the case of manufacturing defects, incorrect shipments, or any other reason attributable to De La Cours.
- The shipment remains entirely under the customer’s responsibility until proof of delivery at the De La Cours warehouse. The right of withdrawal applies exclusively to the product in its entirety and cannot be exercised only for part of the purchased product.
Without prejudice to restoration costs for verified damage to the original packaging, De La Cours will refund the customer within 14 days from receipt of the returned product.
The customer loses the right of withdrawal if De La Cours determines:
- partial use of the product or accessories;
- missing original external or internal packaging;
- absence of integral product components;
- absence of the warranty included with the product;
- damage caused by reasons other than transport.
In such cases, the products will remain stored at the De La Cours warehouse and available for collection at the customer’s expense.
11. Return Policy
Return shipping costs will be covered by De la Cours provided that the user follows the return procedure and uses the courier indicated by De la Cours. If the user chooses another shipping method, return shipping costs will be borne by the user.
To return products, users must contact De la Cours Customer Support via email at info@delacours.it or via WhatsApp and request return authorization.
If the user requests a return but subsequently fails to return the products, De la Cours reserves the right to charge the costs incurred for arranging the return collection. De la Cours also reserves the right to request compensation for returned products that are found to be damaged or used.
Once De la Cours has received and approved the returned items, De la Cours will confirm receipt and process the refund via email. Refunds are generally processed within fourteen (14) days from receipt of the customer’s email request, except during Christmas or peak periods.
12. Additional Information
De la Cours recommends printing a copy of these Terms of Sale for future reference.
The contract and all communications between you and De la Cours shall be in Italian.
The formation, existence, interpretation, execution, validity, and all aspects relating to these Terms of Sale are governed by Italian law.
Any dispute involving consumers arising from or related to these Terms of Sale or the use of the Site shall fall under the jurisdiction of the court of the consumer’s place of residence or domicile if located in Italy. In all other cases, including where the user is not considered a consumer under applicable law, jurisdiction shall lie exclusively with the Court of Arezzo.
If any provision of these Terms of Sale is deemed invalid or unenforceable, it shall be considered ineffective without affecting the validity and enforceability of the remaining provisions.
Any delay or failure by De la Cours to exercise any right or remedy under these Terms of Sale shall not constitute a waiver thereof.
13. Dispute Resolution
Pursuant to Article 49 paragraph 1 letter V of Legislative Decree no. 206 of September 6, 2005 (Consumer Code), customers may use the Joint Conciliation Procedure.
The procedure may be initiated if, after submitting a complaint to the company, the consumer has not received a response within 45 days or has received a response deemed unsatisfactory.
